Can I Choose Someone Else If My Wali Is Not Practicing?

Q Having a wali is one of the requirements in order to get married. What happens if the wali is not practicing? Can someone else replace him? Do we get to choose who?

Answer

In the Name of Allah, Most Gracious, Most Merciful.

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.


In this fatwa:

1- In your wali (marriage guardian) is not a practicing Muslim and he does not have the best of your interest, then you should go to a higher authority and a third party.

2- You can go to the imam of the Islamic center or the leader of the community. They all can be your guardian.
