Q When a couple gets divorced, it is mentioned that if the woman remarries another man, any children that the couple have goes to the children's father. Why is this so? Is this true?

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.

In this fatwa:

  • These types of custody of the children must be dealt with on a case by case basis. Most scholars say that in this case it is true, but this is a generic ruling.
  • The goal is to protect the children. In some societies, step-fathers may be abusive or unfair to his wife’s children.
  • However, the scenario could be different – the stepfather could be the better alternative.
  • Know your situation and seek help if the matter is not clear for you.
