In this fatwa:
Your marriage with your husband is automatically terminated by your conversion to Islam. This means, you are no longer permitted to have conjugal relations. Pray to Allah earnestly and persistently to open your husbandโs heart to the truth of Islam.
Responding to your question, Sheikh Ahmad Kutty, a senior lecturer and an Islamic scholar at the Islamic Institute of Toronto, Ontario, Canada, states:
Your marriage with your husband, according to the strict laws of Islam, is automatically terminated by your conversion to Islam. However, you are allowed to wait patiently for some time to give him a chance to recognize the beauty of Islam and convert to it on his own free will. If he does convert, you can resume your conjugal relations, without a new nikah (marriage).
My advice to you is that you turn to Allah. Pray to Allah earnestly and persistently to open your husbandโs heart to the truth of Islam. Surely only Allah alone can guide people. In the meantime, wait patiently and be gentle with him and never lose your temper with him.
However, at the same time, you should maintain separate sleeping arrangements and observe rules of hijab (Islamic dress code) while in his presence.
Of course, this means you are no longer permitted to have conjugal relations. While the difficulties you are facing are understandable, you must remember that Allah has assured us in the Quran, โwhoever remains conscious of Allah, Allah will appoint for him/her a way out of his/her difficulty,โ (At-Talaq 65:2) and โVerily with hardship comes ease.โ (Ash-Sharh 94:6)
