Does Sex during Iddah Revoke Divorce?

28 September, 2024
Q My husband gave me a revocable divorce and during my 3 month of iddah we had intercourse on several occasions. Is this act considered he had done ruju with me or we had committed zina? Am I still his wife or not? When my 3 months are over, can I marry someone else, or go back to my previous husband? I would appreciate your response. Thanks.

Answer

In the Name of Allah, Most Gracious, Most Merciful.

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.

In this fatwa:

If the two married spouses engage in an intimate relation during iddah (waiting period), the divorce revokes and they are still in marriage.

In his response to your question, Sheikh Ahmad Kutty, a senior lecturer and an Islamic scholar at the Islamic Institute of Toronto, Ontario, Canada, states:

If you did consensually engage in sexual intercourse during iddah (waiting period), then the divorce has been revoked and you remain in marriage.

Hence you are not allowed to consider marrying another man.

 Almighty Allah knows best.
