Request for Clarification on Pregnancy out of Wedlock

Wa `alaykum As-Salamu wa Rahmatullahi wa Barakatuh

 

In the Name of Allah, the All-Merciful, the Mercy-Giving

 

All praise is due to Allah. Peace and blessings be upon His Messenger Muhammad.

 

What this sister did is an enormous sin akin to fornication. One of the reasons for the prohibition of fornication is to protect lineages against chaos caused by illicit relationships.

 

Artificial insemination outside wedlock gained the consensus of contemporary Muslim scholars on its prohibition. Even in classical fiqh literature, scholars discussed the issue of a woman inserting the semen of a man (other than her husband) inside her vagina and considered this act akin to fornication.

 

Though this may not necessitate the prescribed penalty for actual fornication, it still requires discretionary punishment.

 

Therefore, this sister needs to repent sincerely to Allah for committing such a sin. She needs also to strengthen her faith in and reliance on Allah.

 

Marriage and children are provisions granted by Allah, the All-Providing. The Messenger of Allah (peace be upon him) said, “The Holy-Spirit (Gabriel) inspired into my heart that no soul shall die before completing its due term of life and provision. So, fear Allah and seek [provision] in the best way. Let not your thought that a provision has delayed drive you to seek it through disobeying Allah. For what is with Allah cannot be sought except through obeying Him.”

As for the baby, it will be attributed to the mother’s family.
