Wa `alaykum as-Salamu wa Rahmatullahi wa Barakatuh.
In the Name of Allah, Most Gracious, Most Merciful.
All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.
In this fatwa:
1- If by going for Hajj or `Umrah you will not infect other people, then you can go.
2- But if this disease is infectious and other people will get infected, you are not allowed to go for Hajj or `Umrah.
In his response to your question, Sheikh Ahmad Kutty, a senior lecturer and an Islamic scholar at the Islamic Institute of Toronto, Ontario, Canada, states:
If HIV cannot be transmitted by casual contacts or interactions, then you are allowed to travel for Hajj or `Umrah.
If, however, there is any risk of passing on any disease to other people, then you, or anyone else in such a state, must not go for Hajj, for by doing so you may endanger the health of others.
If, the Saudi authorities, after having being informed of your condition, grant you a visa, then you should go as long as your health permits.
If they don’t, then you are absolved of the duty, while you may gain rewards by doing other virtuous deeds you can afford to do.
