Is Marriage Valid Without Wudu?

08 August, 2024
Q I performed my marriage contract while in a state of major ritual impurity (janabah), and I was unaware of it at the time. Is there any issue with this? Does this invalidate the marriage contract? What should I do if the contract is invalid?

Answer

In the Name of Allah, Most Gracious, Most Merciful.

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.

In this fatwa:

Your marriage contract is valid, and it is not a condition for the validity of the marriage contract that the person entering into the contract be in a state of ritual purity from major or minor impurity.

Answering your question, the Fatwa Center at IslamWeb, states:

There is no connection between ritual purity and the contract itself. Rather, ritual purity is required for certain acts of worship, such as prayer, circumambulation (Tawaf), and touching the Mushaf (Quran).

Almighty Allah knows best.
